U.N. observers in Syria suspend patrols

BEIRUT (AP) ? U.N. observers suspended their patrols in Syria on Saturday due to a recent spike in violence, the strongest sign yet that an international peace plan was unraveling despite months of diplomatic efforts to prevent the country from plunging into civil war.

The U.N. observers have been the only working part of a peace plan brokered by international envoy Kofi Annan, which the international community sees as its only hope to stop the bloodshed.

The plan called for the foreign monitors to check compliance with a cease-fire that was supposed to go into effect on April 12, but they have become the most independent witnesses to the carnage on both sides as government and rebel forces have largely ignored the truce.

Maj. Gen. Robert Mood, the U.N. mission chief, said intensifying clashes over the past 10 days were "posing significant risks" to the 300 unarmed observers spread out across the country, and impeding their ability to carry out their mandate.

The observers will not leave the country but will remain in place and cease patrols, Mood said in a taped statement, adding the suspension would be reviewed on a daily basis. Teams have been stationed in some of Syria's most dangerous cities, including Homs and Hama.

"The lack of willingness by the parties to seek a peaceful transition, and the push towards advancing military positions is increasing the losses on both sides," Mood said.

The decision came after weeks of escalating attacks, including reports of several mass killings that have left dozens dead.

The U.S. reiterated its call for the Assad regime to comply with the plan, "including the full implementation of a cease-fire."

Underscoring the dangers, activists reported at least 50 people killed in clashes and shelling in several Syrian cities.

The peace plan's near-collapse has increased pressure on the international community, including President Bashar Assad's staunch allies Russia and China, to find another solution. But there has been little appetite for the type of military intervention that helped oust Libya's Moammar Gadhafi, and several rounds of sanctions have failed to stop the bloodshed.

Najib Ghadbian of the main Syrian opposition group, the Syrian National Council, said the concerns expressed by the U.N. mission could pressure Russia to allow more censure of Assad's regime.

"They are really under pressure to say 'OK, what's next?'" he said. Are they going to continue to sabotage other ideas to protect civilians in Syria?"

Despite fears that violence could significantly worsen without U.N. monitors on the ground, activist Rami Abdul-Rahman of the Britain-based Syrian Observatory for Human Rights said their numbers were too small, and the conflict too large, for them to have any use.

"A lot of crimes happened in Syria, and they couldn't do anything," he said. "The situation can't get worse than this: are we afraid that it's a civil war? Well it is a civil war."

The Syrian government, meanwhile, said it had informed Mood it understood the U.N. observers' decision and blamed rebels for the escalation in fighting.

"Armed terrorist groups have conducted, since the signing of the Annan plan, an increase in criminal operations that have targeted, many times, the observers, and threatened their lives," the Syrian foreign ministry said in a statement. Damascus frequently refers to rebels as "terrorists" instead of Syrians seeking reforms.

The opposition, for its part, has blamed the regime for the attacks near the observers.

Last week, a U.N. convoy was blocked and attacked with stones, metal rods and gunfire by an angry crowd as it was trying to head to the town of Haffa in the coastal Latakia region, where troops had been battling rebels for a week.

The observers only managed to enter once government troops had seized the area back from the rebels.

On May 15, a roadside bomb damaged the observers' vehicles shortly after they met with Syrian rebels in the northern town of Khan Sheikoun. A week earlier, a roadside bomb struck a Syrian military truck in the south of the country just seconds after Mood drove by in a convoy.

National Security Council spokesman Tommy Vietor said the Obama administration was now consulting with allies about "next steps toward a Syrian-led political transition" in compliance with the U.N. resolutions setting up the peace plan. He didn't give further details.

Opposition groups say more than 14,000 civilians and rebels have been killed since the uprising began in March 2011. The initially peaceful protests seeking Assad's ouster have morphed into an armed insurgency as his opponents take up weapons.

Abdul-Rahman, of the Syrian Observatory for Human Rights, has said more than 3,400 Syrian soldiers and pro-government militiamen have been killed.

The Syrian government has been waging a fierce offensive through towns and villages nationwide for the past week, trying to pound out rebels by shelling urban areas with tanks and attack helicopters. Rebels also have attacked Syrian forces, mostly trying to burn out their tanks.

The Observatory said more than 50 people were killed in clashes and shelling in towns close to Damascus, in the central provinces of Homs and Hama, in the seaside province of Latakia, the northern provinces of Idlib and Deir al-Zour and the southern province of Daraa.

Those included 12 people, including a man, his wife and child, who died during overnight government shelling in the Damascus suburb of Douma and seven killed by a mortar shell that ripped apart a bakery in Homs, according to Abdul-Rahman.

The Observatory said that the bodies of 11 people including one woman had been discovered in the capital's suburb of Saqba. It said some of them were "butchered." A video posted online showed a group of lifeless men crammed into a room with stab wounds, blood still spilling from one of them. The LCC reported 13 victims and provided the names of nine, saying some were "slaughtered with knives."

Rebels appeared to kill an accused regime collaborator in an amateur video that was uploaded Saturday, repeatedly shooting his lifeless body.

There was no way of verifying government or activist claims because Syria does not allow reporters work independently. With U.N. observers now grounded, not even partial, independent confirmation of the deaths was available.

Syria's state news agency also said their forces killed a top al-Qaeda fighter on Saturday. They accused Walid Ahmed al-Ayish of organizing suicide car bombings in Damascus over the past few months.

In a first of its kind study in the U.S., researchers at the Perelman School of Medicine at the University of Pennsylvania have shown that the addition of graphic warning labels on cigarette packaging can improve smokers' recall of the warning and health risks associated with smoking. The new findings are published online-first in the American Journal of Preventive Medicine.

In past studies in Europe and Canada, graphic warning labels have proven to be effective in eliciting negative responses to smoking, increasing reported intention to quit smoking in smokers, and modifying beliefs about smoking dangers. However, these previous research results have generally been conducted using large, population-based studies that could be confounded by concurrent tax increases or anti-smoking media campaigns that coincide with the introduction of new warning labels.

"An important first step in evaluating the true efficacy of the warning labels is to demonstrate if smokers can correctly recall its content or message," said Andrew A. Strasser, PhD, associate professor, Department of Psychiatry at Penn and lead author of the new study. "Based on this new research, we now have a better understanding of two important questions about how U.S. smokers view graphic warning labels: do smokers get the message and how do they get the message."

In the study, 200 current smokers were randomized to view either a text-only warning label advertisement, which was unaltered and utilized the Surgeon General's warning and Federal Trade Commission (FTC) testing information that has appeared on cigarette advertisements since 1985; or a graphic warning label version that contained a graphic image (depicting a hospitalized patient on a ventilator) and a health warning with larger text, similar to what has been proposed by the FDA to be adopted in the U.S.

In order to gauge how the participants viewed the layout of the advertisements, the research team utilized sophisticated eye-tracking technology. With this equipment, they were able to measure dwell time (total time viewing various parts of the ad, including the text or graphic warning), time to first viewing of portions of the ad to assess how attention is drawn, and fixations or the number of times they viewed each area of the ad (including the text or graphic warning). After reading the ads, each study participant also had to rewrite the warning label text to demonstrate their recall of the information.

Researchers found a significant difference in percentage correct recall of the warning label between those in the text-only versus graphic warning label condition, 50 percent vs. 83 percent. In addition, the quicker a smoker looked at the large text in the graphic warning, and the longer they viewed the graphic image, the more likely they were at recalling the information correctly.

The researchers say that the new data demonstrates that drawing attention to the warning label can improve recall of health relevant information, which may extend to improving risk perception of smoking. Additionally, attracting attention to the warning before viewing the advertisement body may change the framing of the message in the advertisement body, causing viewers to approach it with greater caution. Finally, time to first viewing has practical application to real-world settings where people may allocate only a few seconds to a print advertisement. Further study on the size, font, color, and location of text may identify the most effective way to draw attention.

"In addition to showing the value of adding a graphic warning label, this research also provides valuable insight into how the warning labels may be effective, which may serve to create more effective warning labels in the future," said Dr. Strasser. "We're hopeful that once the graphic warning labels are implemented, we will be able to make great strides in helping people to be better informed about their risks, and to convince them to quit smoking."

The 2009 Family Smoking Prevention and Tobacco Control Act mandated the FDA to require graphic warning labels on cigarette packages. Originally mandated to appear on cigarette packages in September 2012, the implementation of these warning labels has been held up in court.

Strasser and colleagues note that the current study was designed to gauge short-term recall of the graphic warning information and that additional research addressing long-term recall and behavior changes are currently underway at Penn.

As I write this, deadlines for submission to various legal ranking directories are fast approaching. This one is a survey where you rank lawyers in your field. That one is an interview where you?re asked who (after you, of course) is the best in your field. Another asks to whom you would refer a client if you couldn?t act for that client. Their timetables, criteria, and requirements are all different. Lawyers find the submission process laborious, unproductive, and frustrating. However, they are even more frustrated when they see their competitors? names ranked above their own names (or worse, not seeing their own names in the rankings. Directory Submissions are the Marketing Department?s worst nightmare after the dreaded Holiday Cards and just above Award Nominations.

It?s fair enough to ask why we bother. Aren?t all these directories just money-making ego-boosters? Or do some of them, at least, provide clients with a measure of comparison between law firms, practice groups and lawyers? And if they do, are they a means of building reputation, both for the firm and for individual lawyers?

It?s a nebulous thing, reputation. Basically, it involves what other people say about you. For business development, you want the best things to be said about you by your prospective clients? other professional advisers, like their lenders, insurers, and accountants. It?s really sweet, too, when lawyers who face you across the courtroom or the deal table admit that you know your stuff. If your ideal client is in your immediate vicinity where you don?t have a lot of competition, then getting ranked in directories probably isn?t high on your marketing to-do list. Stay in close touch with your local bankers, insurance brokers, and accountants?and you?ll do just fine if you do good work.

But law is no longer just a local service. This year we saw the first of Canada?s law firms (Ogilvy Renault) join an international firm (Norton Rose). If you want international work, or top-of-the-line specialized work, or if there are many lawyers jostling for the same clients, that?s when a third party endorsement comes in handy. It?s also a handy card to play when attracting an up-and-comer to your practice group (?Our group is ranked in??).

I usually explain reputation management as the third leg of the stool, where the first leg is business development (bringing in new clients or new work from existing clients) and the second is retention strategies (more about this in another column). Managing reputation supports business development and client retention. Like every other marketing initiative, it needs to be thought through strategically, in relation to a business goal. Don?t just respond to every ?Congratulations! You have been named a Leading Lawyer in?? email that you receive (many of these are little more than scams, but that?s another topic entirely). Proactively decide if being ranked in a particular directory will support your goals as a firm, evaluate what it takes to become ranked, and then decide whether the effort is warranted. If it is, build it in to your annual marketing plan and measure the results.

A spinoff value of directory submissions is that lists of representative work are kept current and lawyers? profiles are updated in order to meet deadlines. These are core marketing materials that can be used in many different ways, from websites to proposals.

So why not just put all your efforts into your website? Well, if you?re going to do only one thing to manage your reputation, building an interesting website that clearly describes how you solve clients? problems would be that one thing. But in today?s competitive marketplace, one thing is unlikely to help you keep pace with the competition.

Reputation is enhanced by speaking at conferences, writing articles, and playing an active role in industry associations. And guess what? All of those things form part of your website content, proposal content?and your directory submission.

I frequently hear the comment: ?Clients don?t choose their law firm from a directory.? As I said at the beginning, clients check with their other advisors when deciding on a law firm. But remember, they have to justify their decisions to their management. It doesn?t hurt to be able to say of your choice ?and they?re also ranked in??

Ultimately it all comes back to the fact that clients make the choice. And just in case you think I?ve been paid off by the directories, let me finish with an example of clients using an objective measure of practice experience. In debrief interviews after submission of proposals, I always ask clients how the law firm got onto their list of firms to be invited. In the last three interviews, the answer has been the same: ?We sent the RFP to everyone who was listed as a Certified Specialist in this practice area.? If you?ve ever wondered whether it was worth getting your Certified Specialist designation as a way of standing out from the crowd, there?s your answer.

I usually explain reputation management as the third leg of the stool, where the first leg is business development (bringing in new clients or new work from existing clients) and the second is retention strategies (more about this in another column). Managing reputation supports business development and client retention. Like every other marketing initiative, it needs to be thought through strategically, in relation to a business goal. Don?t just respond to every ?Congratulations! You have been named a Leading Lawyer in?? email that you receive (many of these are little more than scams, but that?s another topic entirely). Proactively decide if being ranked in a particular directory will support your goals as a firm, evaluate what it takes to become ranked, and then decide whether the effort is warranted. Reputation is enhanced by speaking at conferences, writing articles, and playing an active role in industry associations. And guess what? All of those things form part of your website content, proposal content?and your directory submission.

I frequently hear the comment: ?Clients don?t choose their law firm from a directory.? As I said at the beginning, clients check with their other advisors when deciding on a law firm. But remember, they have to justify their decisions to their management. It doesn?t hurt to be able to say of your choice ?and they?re also ranked in??

Ultimately it all comes back to the fact that clients make the choice. And just in case you think I?ve been paid off by the directories, let me finish with an example of clients using an objective measure of practice experience. In debrief interviews after submission of proposals, I always ask clients how the law firm got onto their list of firms to be invited. Two people were injured today when their ultralight plane crashed into the water south of St. Petersburg, and they were rescued by a fisherman who saved a motorist the day before, firefighters said.

Rodney Tyoe, 74, and his passenger, Gina Zimmerman, 55, both of St. Petersburg, had taken off about noon from a strip of beach in Tierra Verde and reached an altitude of 100 feet when the aircraft began having trouble, said Lt. Joel Granada, a spokesman for St. Petersburg Fire Rescue.

According to Tyoe, an experienced pilot, the wind began affecting the aircraft and he descended to 30 feet when the wind flipped the aircraft, Granada said. The ultralight plummeted tail first into the water in an area known as Indian Key.

Gus Hertz, of Roanoke, Va., a fisherman who was watching the ultralight, picked up Tyoe and Zimmerman and took them to O'Neill's Marina in south St. Petersburg, Granada said.

Hertz also was one of two men who pulled a driver to safety from his submerged BMW Wednesday morning after it was driven off the Pinellas Bayway in St. Petersburg. Hertz had seen the crash from his condo.

Search and rescue crews arrived and picked up Tyoe and Zimmerman from Hertz, Granada said.

One of the crash victims was taken to Bayfront Medical Center for treatment and the other was being evaluated, Granada said.

Arrangements are under way to remove the aircraft from the water, Granada said.

St. Petersburg Fire Rescue plans to honor Hertz with a "Citizen's Heroic Award" in November.

Ohio to gain from AIG workers' compensation settlement | Columbus ...

A settlement reached with American International Group will see some funds distributed to Ohio, as well as each of the other 49 states. AIG and its workers' compensation insurance affiliates will pay $146.5 million to settle the allegations made against them.

According to an insurance commissioner involved in the case, the companies involved underestimated their liabilities. These underestimations resulted in skewed premium reporting. Inaccurate reports from companies such as this can cause severe logistical hiccups for state insurance regulators and other groups, as well.

In addition to the financial payout, the settlement requires AIG to review previous financial reports and correct them as needed. The company will also have to reallocate about $2.1 billion of premiums from other lines of insurance to its workers' compensation funds.

The $146.5-million settlement has to be paid by June 30. The settlement can be broken down into two payments: $100 million for penalties and $46.5 million for additional premium taxes and assessments. An official with the investigation said that, by agreeing to this settlement, AIG has shown that it is committed to a culture of regulatory compliance.

With this case finalized, workers' compensation will be less likely to experience any unexpected fluctuations in cost, which could end up affecting both employers and employees. It is not known how much Ohio will get in the settlement, but it's important that insurers learn their lessons from this matter, so that Ohio workers are able to get the compensation benefits they need should they be injured.

However, it remains unclear whether such fertility could have unexpected downsides for life in the Arctic, researchers said.

The single-celled organisms in question are known as phytoplankton, which possess the?green pigment chlorophyll?just as plants do, helping them live off sunlight. They are vital to life in the seas, serving as the?basic food source?for many ocean animals. Indeed, they are key to life on Earth ? they account for about half of the total oxygen produced by all plant life.

Phytoplankton blooms?spring up in the Arctic during the summer, when the sun is constantly above the horizon. Scientists have largely assumed that the growth and amount of phytoplankton was negligible in waters beneath the ice there, although there were hints of phytoplankton blooms under the ice in the Barents and Beaufort seas and the Canadian Arctic Archipelago.

"As someone who has been studying polar marine ecosystems for 25 years, I had always thought that the idea of under-ice phytoplankton blooms was nonsense," said researcher Kevin Arrigo, a biological oceanographer at Stanford University in California. "There is simply not enough light getting through the ice into the ocean for them to grow."

As it turns out, phytoplankton not only flourishes under?thick layers of ice, but grows in numbers about four times higher under the ice than in the open water.

"The idea that phytoplankton can not only bloom under 3-foot-thick ice but that they can reach numbers that put their open-water counterparts to shame was a complete surprise," Arrigo told OurAmazingPlanet. "It means we have to rethink many of our ideas about how the Arctic Ocean ecosystems function."

Phytoplankton surprise

Arrigo and his colleagues were in the Arctic on the ICESCAPE cruise ? ICESCAPE standing for Impacts of Climate on EcoSystems and Chemistry of the Arctic Pacific Environment ? to study how ocean life was responding to recent declines in sea ice levels.

"Most of the difficulties in conducting the research were related to bashing through the ice to get to our study areas," Arrigo said. "In one instance, it took our icebreaker, the USCGC Healy, more than eight hours to go three ship lengths. We were surrounded by sea ice more than 15 feet [4.5 meters] thick and I thought we would never get out." [Images: Icebreaker in Action]

"As the ship moved from the open water into the ice pack, the instrument that tells us how much phytoplankton are in the water started to produce very high numbers," Arrigo said. "I thought this was odd since there shouldn't be phytoplankton under the ice. I actually feared that our instrument was malfunctioning."
